Local Father Trying To Shake Up Custody Laws To Get Equal TimeFt. Mill, SC - Jeremy Walters says, “That's all I've ever wanted to do is be 'Dad.'" Walters calls the day his son was born the best day of his life. But after a three year custody battle he says he only gets to be dad every other weekend. He says, “Four days a month, the status quo." The Ft. Mill resident set out to change the status quo. His campaign for a shared parenting law gained steam in March after Gov. Nikki Haley offered to help him get support. South Carolina House Bill 4095 seeks to change the law so that: “If joint legal custody of a child is awarded to the parents, there is a rebuttable presumption that both parents have joint physical custody of the child. Joint physical custody of the child is defined as equal time-sharing.” It would be up to the challenging parent to prove that equal custody isn't in the child's best interest. Family law attorney Leigh Sellers says it might not be that easy. Sellers says, “The system shouldn't minimize the involvement of an interested, concerned, dedicated & loving parent." Sellers the bill idea is great, but equal access doesn't always work. Sellers says, “What the child was doing is bouncing between two lives and not really having a life." Walters says, “It's better than a child being without a parent." His custody battle is settled, so this bill won't help. Walters says, “All I wanted was equal time & joint custody with my son. That's all I wanted." But he hopes his fight will save other parents from missing out on time with their kids, “The only thing we have left it our families, that's what we need, we need to be together." The bill is expected to come up when lawmakers return next month. York County Representative Deborah Long says she supports it, but says more questions need to be asked and answered. |
